DMCA & Copyright Policy

How Voltasis handles copyright infringement claims under the Digital Millennium Copyright Act.

1. Respect for Intellectual Property

Voltasis LLC ("Voltasis") respects the intellectual property rights of others and expects users of the Voltasis platform to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws.

2. DMCA Takedown Notices

If you believe that content hosted on the Voltasis platform infringes your copyright, you may submit a written notification to our designated agent with the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including information reasonably sufficient to permit Voltasis to locate the material.
  4. Information reasonably sufficient to permit Voltasis to contact you, such as an address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright that is allegedly infringed.

Please include "DMCA Takedown Notice" in the subject line of your email.

4. Counter-Notification

If you believe that content you uploaded to the Service was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated agent with the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Voltasis may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Voltasis will forward it to the original complainant and restore the removed material within 10 to 14 business days, unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity.

5. Repeat Infringers

In accordance with the DMCA, Voltasis will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. Voltasis may also, at its sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.

6. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.
